The following Privacy Statement applies for the use of our online offering, eversgmbh.de (hereafter "website").

We place a lot of importance on data protection. The collection and processing of your personal data takes place in consideration of the applicable provisions on data protection, in particular the General Data Protection Regulation (GDPR). We collect and process your personal data in order to be able to provide you with the above-mentioned portal. This Statement describes how and for which purposes your data are collected and used and what options you have with regards to your personal data. By choosing to use this website, you agree to your data being collected, used and transferred according to this Privacy Statement.

Data Controller

The Data Controller for the collection, processing and use of your personal data according to Art. 4(7) GDPR is Evers GmbH, Graf-Zeppelin-Straße 10-12, 46149 Oberhausen, Germany. If you wish to object to the collection, processing or use of your data by us according to these provisions on data protection, as a whole or relating to individual measures, you can send your objection to the Data Controller. You can save and print this Privacy Statement at all times.

General use of the website

Hosting

The purpose of the hosting services we use is to make the following services available: infrastructure and platform services, computing capacity, storage space and database services, security services and technical maintenance services, which we use for the purpose of operating the website.
In doing so, we or our hosting providers process inventory data, contact details, content data, contractual data, usage data and meta and communication data relating to customers, interested parties and visitors to this online offering based on our legitimate interests in making this online offering available in a way that is efficient and secure according to Art. 6(1)(1)(f) in conjunction with Art. 28 GDPR.

Access data

We collect information about you when you use this website. We automatically record information about your usage behaviour and your interaction with us as well as data on your computer or mobile device. We collect, save and use data every time our online offering is accessed ("server log files"). 

We use this protocol data without assigning it to your identity or other profile creations for statistical analysis for the purpose of operating, securing and optimising our online offering, but also for anonymous recording of the number of visitors to our website (traffic), as well as relating to the scope and way in which our website and services are being used, even for billing purposes, in order to measure the number of clicks made by our collaborators. Based on this information, we can make personalised, localised content available as well as analysing data traffic, searching for errors and improving our services. Our legitimate interests according to Art. 6(1)(1)(f) GDPR also lie in this area.

We reserve the right to subsequently review protocol data if there is a justified suspicion of illegal use based on specific indications. We store IP addresses in the log files for a limited period if this is required for security purposes, service provision or billing of a service, e.g. if you use one of our services. We delete the IP address following cancellation of the order process or receipt of payment if this is no longer required for security purposes. We also store IP addresses if we have concrete suspicions of a criminal offence relating to the use of our website. Furthermore, we store the date of your last visit under your account (e.g. during registration, login, clicking on links, etc.).

Cookies

We use so-called session cookies to optimize our online offer. A session cookie is a small text file that is sent by the respective server when you visit a website and is temporarily stored on your hard drive. This file as such contains a so-called session ID, with which various requests from your browser can be assigned to the common session. This enables your computer to be recognized when you return to our website. These cookies are deleted after you close your browser. They serve z. For example, you can use the shopping cart function across several pages.

We also use persistent cookies to a small extent (also small text files that are stored on your device), which remain on your device and enable us to recognize your browser the next time you visit. By activating cookies, this is assigned an identification number, but your personal data is not assigned to this identification number. Your name, IP address or similar data, which would enable cookies to be assigned to you, are not included in the cookie. Based on cookie technology, we only receive pseudonymised information, for example about which pages for our shop were visited, which products were viewed, etc.

You can set your browser so that you are informed about the setting of cookies in advance and can decide in individual cases whether you exclude the acceptance of cookies for certain cases or in general, or that cookies are completely disabled. This can limit the functionality of the website.

E-mail Contact

If you contact us (e.g. via contact form or email), we will save your details for processing the request and in the event that follow-up questions arise. This is also our legitimate interest in accordance with Art 6(1)(1)(f) GDPR.

We only store and use other personal data if you give your consent or if this is legally permitted without special consent.

Google Analytics

We use Google Analytics, a web analytics service provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland ("Google"). Google has submitted to the Privacy Shield Agreement between the European Union and the USA and has been certified. As a result, Google is committed to complying with the standards and regulations of European data protection law. Google Analytics uses "cookies", which are text files stored on your computer and which enable your use of the website to be analysed. The information generated by the cookie on the use of this website by its visitors is generally transferred to a Google server in the USA and stored there. Our legitimate interests according to Art. 6(1)(1)(f) GDPR also lie in this area.

In the event that IP anonymisation is activated on this website, your IP address will be shortened by Google prior to the transfer if this takes place within a Member State of the European Union or in other contracting countries to the agreement on the European Economic Area. Only in exceptional cases will the full IP address be transferred to the Google server in the USA and shortened there. IP anonymisation is active on this website. Google will use this information on our behalf to analyse your use of our website, to compile reports on website activities and to provide us with further services relating to website and Internet use.

The IP address submitted by your browser within the context of Google Analytics will not be combined with other data from Google. Facebook  

We use the conversion pixel or visitor action pixel from Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA ("Facebook"). By accessing this pixel in your browser, Facebook can subsequently detect whether a Facebook ad was successful, i.e. whether this led to an online purchase being made. For this purpose, we only receive statistical data from Facebook without any references to specific people. In this way, we can record the effectiveness of Facebook ads for statistical and market research purposes. Legal bases and storage period

The legal basis for data processing according to the above clauses is Art. 6(1)(1)(a), (b) and (f) GDPR. In particular, our interests in data processing lie in initiating, concluding and fulfilling contracts, as well as in direct advertising and product information.

Unless specifically stated, we only store personal data for as long as this is required for fulfilling the intended purpose or by law.

Your rights as the Data Subject

Right to confirmation and information

At all times, you have the right to receive a confirmation as to whether your personal data is being processed. If this is the case, you therefore have the right to demand information from us free of charge on your stored personal data as well as a copy of this data. Furthermore, you have a right to the following information:

  1. the purpose of processing;
  2. the categories of personal data that are being processed;
  3. the recipients or categories of recipient to whom your personal data have been disclosed or are still being disclosed, especially in the case of recipients in third countries or international organisations;
  4. if possible, the planned period during which your personal data will be stored or, if this is not possible, the criteria for determining this period;
  5. the existence of a right to correct or delete your personal data or restrict processing by the Data Controller or a right to object to this processing;
  6. the existence of a right to complain to a supervisory authority;
  7. if the personal data were not submitted by you, all available information on the origin of these data;
  8. the existence of automated decision-making, including profiling, according to Article 22(1) and (4) GDPR and, at least in these cases, meaningful information on the logic involved, as well as the scope and envisaged effects of this type of processing for you.

If personal data are transferred to a third country or an international organisation, you have the right to be informed of appropriate guarantees according to Art. 46 GDPR with regards to the transfer.

Right to correct

You have the right to demand from us the immediate correction of inaccurate personal data relating to you. In consideration of the purposes for the processing, you have the right to demand completion of incomplete personal data, also by means of an additional statement.

Right to delete ("right to be forgotten")

According to Art. 17(1) GDPR, you have the right to demand from us that your personal data be deleted immediately and we are therefore obligated to delete your personal data immediately, unless one of the following reasons applies:

If we have released personal data and we are obligated to delete it according to Art. 17(1) GDPR, we will take appropriate measures considering the available technology and implementation costs as well as the technical type in order for the Data Controller for the data processing, who is processing the personal data, to be informed that you have requested the deletion of all links to these personal data or of copies or reproductions of these personal data.

  1. The personal data are no longer required for the purposes for which they were collected or otherwise processed.
  2. You withdraw your consent on which the processing according to Art. 6(1)(1)(a) GDPR or Art. 9(2)(a) GDPR is based and there is no other legal basis for the processing.
  3. According to Art. 21(1) GDPR, you object to the processing and there are no overriding, legitimate reasons for the processing or you object to the processing according to Art. 21(2) GDPR.
  4. The personal data were illegally processed.
  5. Deletion of the personal data is required in order to fulfil a legal obligation under Union law or the laws of Member States to which we are subject.
  6. The personal data were collected in relation to information society services provided according to Art. 8(1) GDPR.

Right to restrict processing

You have the right to demand restriction of processing from us if the following conditions apply:

  1. the accuracy of the personal data is disputed by you, and indeed for a period that allows us to check the accuracy of the personal data;
  2. the processing is illegal, but you have rejected the option to delete the personal data and instead have demanded that the use of the personal data be restricted;
  3. we no longer require the personal data for the purpose of processing; however, you require the data to assert, exercise or defend legal claims, or
  4. you have raised an objection to the processing according to Art. 21(1) GDPR, but it has not yet been established whether our company's legitimate interests prevail over yours.

Right to data portability

You have the right to receive your personal data, which you have provided to us, in a structured, common and machine-readable format and you have the right to transfer these data to another Data Controller without any hindrance from us:

  1. the processing is based on consent according to Art. 6(1)(1)(a) GDPR or Art. 9(2)(a) GDPR or on a contract according to Art. 6(1)(1)(b) and
  2. the processing is carried out using an automated process.

In exercising your right to data portability according to Paragraph 1, you have the right to request that your personal data are transferred directly from us to another Data Controller, provided that this is technically possible.

Right to object

For reasons arising from your specific situation, you have the right to object to the processing of your personal data at any time based on Art. 6(1)(1)(e) or (f) GDPR; this also applies for profiling carried out based on these provisions. We no longer process the personal data unless we can demonstrate that there are obligatory, protection-worthy reasons for the processing, which prevail over your interests, rights and freedoms, or that the processing is required to assert, exercise or defend legal claims.

If personal data is processed by us in order to operate direct advertising, you therefore have the right to object to the processing of your personal data for the purpose of this type of advertising at any time; this also applies for profiling insofar as this relates to such direct advertising.

For reasons arising from your specific situation, you have the right to object to the processing of your personal data, which takes place for economic or historic research purposes or for statistical purposes according to Art. 89(1) GDPR, unless the processing is required to fulfil a purpose that is in the public interest.

Automated decision-making, including profiling

You have the right not to be subject to decisions that are exclusively based on automated processing, including profiling, which take legal effect against you or significantly affect you in a similar way. Automated decision-making based on collected personal data does not take place.

Right to withdraw consent relating to data protection

You have the right to withdraw your consent to the processing of your personal data at any time.

Right to complain to a supervisory authority

You have the right to complain to a supervisory authority, especially in the Member State in which you reside or work or in which the suspected infringement occurred, if you believe that the processing of your personal data is illegal.

Data security

We place the utmost important on the security of your data within the context of the applicable data protection laws and technical possibilities.

Your personal data is transferred at our end in an encrypted format. This applies for your orders and also for customer logins. We use the SSL (Secure Socket Layer) coding system; however, please note that data transfer on the Internet (e.g. email communications) can have security vulnerabilities. Vulnerability-free data protection against access by third parties is not possible.

To secure your data, we implement technical and organisational measures according to Art. 32 GDPR and we always ensure that these correspond to state-of-the-art technology.

Furthermore, we cannot guarantee that our services will be available at certain times; faults, disruptions or failures cannot be excluded. The servers used by us are regularly and carefully secured.

Transfer of data to third parties, no data transfer to non-EU countries

As a matter of principle, we only use your personal data within our company. If and to the extent that we engage third parties within the context of fulfilling a contract (such as logistics service providers), these parties only receive personal data under the scope in which the transfer is required to perform the corresponding service.

If we outsource certain parts of the data processing ("job processing"), we bind the job processors contractually to only using personal data in accordance with the requirements of data protection laws and to ensuring that the affected person's rights are protected.

Apart from the cases cited in Clause 2 of this Statement, data transfers to agencies or people outside the EU do not take place and are not planned.
