The legal situation is clear. According to the German Road Traffic Act (STVO) and the Commercial Code (HGB), apart from the driver, the loader or sender is responsible for load securing (load restraint). If property damage or personal injuries occur due to improper securing of the load, apart from the compensation claims by the injured parties (e.g. by the insurance companies), all participants can be prosecuted under criminal law.
